By registering, subscribing, or otherwise accessing, using, or interacting with the Service, you confirm your agreement to these Terms, including the policies incorporated by reference (such as our Privacy Policy). If you do not agree to these Terms, you are not permitted to use the Service.

Our Service

StreetExplor provides access to a geospatial intelligence platform and database ("Content"), including data, tools, and features designed to allow users to explore and interact with public safety, environmental, traffic, and real estate data.

Definition of Content

Content includes all data, maps, graphics, text, reports, and other materials accessible through the Service, including but not limited to public safety data, environmental risk data, traffic/crash/hotspot layers, and real estate/neighborhood quality data.

License to Use

Subject to compliance with these Terms, StreetExplor grants you a limited, non-exclusive, non-transferable, non-sublicensable license to access and use the Service for its intended purpose.

Using StreetExplor Service

Eligibility

You may use the Service only if you are 13 years of age or older and comply with all applicable laws. By using the Service, you represent that you meet these requirements.

Prohibited Uses

You agree not to:

• Reverse engineer, decompile, or modify the Service.
• Use the Service for unlawful purposes or in violation of any applicable laws or regulations.
• Sell, sublicense, or commercially exploit the Content without explicit written consent from StreetExplor.
• Use the data, software, or any other materials provided by StreetExplor or accessible via the StreetExplor website to train artificial intelligence (AI) or machine learning models without prior written consent.

AI and Data Usage Restrictions

Prohibition on AI Training: The data, software, and all materials provided through StreetExplor and the StreetExplor website may not be used to train AI or machine learning models under any circumstances without prior, express written consent from StreetExplor.

Requests for Data Use: If you wish to purchase spatial tilesets, use StreetExplor's data, or utilize the Service to train AI or machine learning models, you may submit a request to info@streetexplor.com. Approval is required in writing and at the sole discretion of StreetExplor.

Registration and Account Security

You may be required to create a user account to access certain features of the Service. You agree to:

• Provide accurate and complete registration information.
• Maintain the confidentiality of your account credentials.
• Notify StreetExplor immediately of unauthorized access to your account.

Ownership and Intellectual Property

All intellectual property rights in the Service, including software, Content, and trademarks, are owned by StreetExplor or its licensors, including the geospatial/mapping patent (US20170131115A1). Except for the limited license provided in these Terms, no other rights or licenses are granted.

Content You Provide (User Content)

You may upload or submit content (e.g., custom maps, data, or analysis) to the Service ("User Content"). By doing so, you grant StreetExplor a perpetual, royalty-free license to store, display, and use your User Content to provide the Service.

Privacy Policy

Your use of the Service is subject to our Privacy Policy, which explains how we collect, use, and share your personal data. By using the Service, you consent to our Privacy Policy.

Modifications to Service and Terms

Subscriptions and Payments

Subscriptions to the Service are governed by applicable pricing terms, as detailed on the StreetExplor website, sales order, or through your account dashboard. Subscription terms, cancellations, and refunds are subject to our stated policies.

Disclaimer of Warranties and Limitation of Liability

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. StreetExplor disclaims all warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the fullest extent permitted by law, StreetExplor will not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Service.

Indemnification

You agree to indemnify and hold harmless StreetExplor from any claims, liabilities, damages, or expenses arising out of your breach of these Terms, misuse of the Service, or violation of any third-party rights.

Dispute Resolution

Any disputes arising under these Terms will be resolved through binding arbitration in St. George, Utah, in accordance with the rules of the American Arbitration Association.
